New Ohio Abortion Legislation: Fathers Will Have Final Say

Legislation in the Ohio House of Representatives (House Bill 252) requires written consent from the father of an unborn child in order to perform an abortion.  The bill will put to test the “it’s my body, it’s my right” notion of pro-choice activists by adding the rights of the father of the unborn child into the equation.  Ideally, the decision of abortion should be a consensus between both parents, with both parties being involved in any decisions regarding the child.

This is a significant legal and social issue where parental rights are heavily unbalanced due to the fact that a father plays no role in a matter as critical as his unborn child’s life.  If a woman decides to keep her child, the father is required to pay child support regardless of whether he wanted to keep the child or not, or face future jail time.  A father currently has no say.  Alternatively he cannot opt-out of parenthood, but a woman can: She can do so by abortion.

Under the Ohio Bill, a woman must have written consent from the father; if a woman is claiming rape, she must file a police report, provide other court documents or an official complaint of the incident.  If the woman chooses to undergo an abortion in this case, the physician must have “reasonable cause” to believe the woman’s claim of rape and thus, perform an abortion.  In cases where the father may be unknown, a list of all potential fathers must be submitted to a physician.  They will all be contacted and summoned to a paternity test.  If the father is not found, no abortion can be performed.  The bill would turn abortion without a father’s permission or naming a “false biological father” into a first-degree misdemeanor with a maximum $1,000 fine.  A second occasion of providing false information would be considered a fifth degree felony.

“When the fetus is viable, no person shall perform or induce an abortion on a pregnant woman without the written informed consent of the father of the fetus,” the bill text reads.

State Representative John Adams says that the bill was not written to cause controversy.  He says that it is important that both parties who created the unborn child have a say in whether or not the pregnancy is terminated.  “Since the father will have the responsibility of child support, he should have rights regarding the birth or destruction of the fetus,” according to veteran matrimonial attorney Anthony D’Agostino (http://dadsrights.com).

Recently, an instance regarding an alleged lack of father notification in regards to an abortion has commanded national attention.  In New Mexico, a man lashed out at his ex-girlfriend by means of an anti-abortion billboard after the ex-girlfriend had allegedly undergone an abortion procedure without any notification to the purported father.  The billboard depicts a 35-year-old Greg Fultz holding the outline of an infant with text that reads, “This Would Have Been a Picture of My 2-Month Old Baby If the Mother Had Decided Not To Kill Our Child!”  The case seems more about the ex-girlfriend’s privacy than about father’s rights.

Regarding the paternal veto or override of an abortion, that is a decision which should be eventually decided in Ohio.  This important decision can set legislative precedent for every other state in our nation.

    1.  False claims of rape will increase.  Filing a police report?  Easy.  Leaving unfettered discretion to a physician to determine if “reasonable cause” exists?  That would be pretty easy too.  Assuming the “reasonable cause” would be based on some kind of trauma to the vaginal area, women that want an abortion would of course inflict that on themselves rather than the much more traumatic/vagina damaging experience of childbirth.  

    2.  So if the father isn’t found, the woman becomes host to, then gives birth to a child she doesn’t want and whose father is unknown (a factor which can exist for a variety of reasons)?  What happens to the child after that if the mother still doesn’t want him/her?

    3.  Misdemeanor with max fine of $1,000, or spend nine months going through body change, resenting the unborn child and father, blah blah blah, then give birth.  For someone that wants an abortion, this is, again, quite an easy choice to make.  

    I guess $1,000 is the value of an unborn child.

      If the father isn’t found, and the mother still doesn’t want the child, there are tens of thousands of people who will take him (or her).  I’ve got one right now, and he’s awesome.

      this could work  actually , the mother of the unborn stating rape should be mandatory for her to have the police report filed weeks before she chooses to abort…

    Making a woman have to get the fathers permission to get an abortion will never work!  The feminazi’s will go ballistic !  What is needed is for the legal parental balance to be restored.  Women have too  many rights and choices, while men have virtually none.  Make the laws balanced and fair, take away  priviledges that  have been  converted to rights for women , when its only for women and not men.
    Restore the rights, the real rights, of fathers and men.  REstore much of the decision making power that is rightfully  the fathers and women will begin to understand , they no longer have the upper hand and many women will start to act  more responsible and more respectful of the rights of fathers and men.
    Many of the unplanned pregnancies will stop!  There will be fewer  kids who turn out “messed up” because the family unit will be protected.  The decision to be a parent, to bring children, into the world will be made by both parents, not just the woman and her state sponsors.

      because there are already so many deadbeats out there , my ex owes 27,000 in rears that are unpaid and he wanted both his kids …. it saddly would just be an excuse for men like this NOT ALL , but men like my ex to again get a free pass on life … these are children we are talking about , not robots , they need things , they need clothing , food , cared for if they are sick … if your man enough to sleep with someone and not use a condom  then you should be a man and take care of your responsibilty ??? right ….

        I personally believe that if a man give his consent to become a father, he IS responsible.

        But what of the men who do NOT want to be a father if birth control fails as nothing but abstinence is 100%.

        Has he no say, right now no, he is financially in debt with no say in the whole process.

        If a woman wants to have a baby with a man who does NOT want to have a child, she should woman enough to know how well she can provide on her own and THEN make a decision for your actions as well.

        The percentage of “deadbeat” moms is actually higher than that of
        dads who won’t pay, even though mothers are more consistently awarded
        custody of children by the courts.

        support — 385,000 women out of a total of 674,000 — give up some or

    I have been telling Wisconsin state legislators this same thing for about a month. Men have NO rights and women have WAY too many when it comes to this. This is shameful. If you don’t want a damn baby, don’t get pregnant!

      You don’t know what Sharia law actually is, do you? Also, it does not look like that at all. It helps to read the article you’re ranting about. There’s nothing here about control (or property, or forbidding footwear). It’s about dismantling a system of female privilege, and giving rights to men as well as women.

    idiotic law actually works in OPPOSITION to the primary cause of the
    Men’s Movement, which is to force the government to respect and
    defend the constitutional rights of men in America. What they should
    have done is to defend men’s rights by reaffirming and making it the
    law of the land that women have no claim and no judicial mechanism to
    steal a man’s money or property unless he has consensually agreed, in
    writing, to any such obligation beforehand. This is the established
    standard for adults interacting in society. Women who would claim to
    merit the status of an adult in society, with all of the inherent
    rights and responsibilities that come with being an adult, must be
    held to this long-established basic standard.

    But
    instead, what these dimwitted legislators in Ohio did was to actually
    endorse the lies and hypocrisy of the countless millions of
    irresponsible women who get themselves knocked up want a man to pay
    for her child. These legislators played right into women’s hands by
    lending credence to women’s false assertion that genetic parentage is
    the determinant in the matter of who should be obligated to
    financially provide for the child. This is evident by the
    legislators use of the term “the father,” with all of the
    obligations they undoubtedly associate with and would assign to “the
    father.”

    We
    know women’s claim that genetic parentage = “the father” is
    patently false because we already have the long-established
    institution of artificial insemination and sperm donors where it is
    recognized that volition, not genetic parentage, is the determining
    factor in the matter of whether there will be any financial
    obligations to provide for the child. Women who donated eggs would
    whine and pout and scream bloody murder if they were forced to pay
    child support for their genetic offspring, so clearly women agree and
    recognize that choice, i.e. volition, is the sole standard in
    determining whether someone should be forced to financially support a
    child. Women’s lies, hypocrisy and lack of character is blatantly
    evident by their claiming a standard where is suits them, and then
    disavowing that very standard and claiming that a totally different
    standard actually applies if it benefits her.

    What about when the father demands that the mother abort a child with a birth defect?  Because I refused to do that I was harassed and verbally abused my entire pregnancy.  Finally after 4 years we are divorced and the father that didn’t want the child has custody.
